Your insurance company can recommend a shop. Under Massachusetts insurance regulation, it cannot require you to use one. Where your car gets repaired is your decision.
“No direct payment plan approved under 211 CMR 123.00, and no insurer in implementing such plan, shall require a claimant to have repairs made at any specific repair shop.”
In plain terms: no insurance company can force you into a specific repair shop.
Read 211 CMR 123.00 on mass.gov (PDF)No insurer can require you to have the repair done at a specific shop. Where you take your car is your call — whether or not the shop is on their list.
The regulation says a claimant may or may not choose to use an insurer's referral shop. Turning down the list is a normal, expected choice.
If you accept direct payment from your insurer, the disclosure they are required to give you must state that you may have repairs made at any repair shop, whether or not it is one of their referral shops.
Some Massachusetts policies include an optional endorsement you have to sign up for: you get a discount on your collision and comprehensive premium in exchange for using a shop the insurer designates. If you have it, the amount paid for a repair outside that network can be lower. Not sure if you have it? Bring your policy in and we will read it with you.
We will not tell you your insurer has to pay whatever a shop charges — that is not how it works. Payment is based on a licensed appraisal. What we do is deal with your adjuster and appraiser directly, in English, Spanish, or Portuguese.
